TERMS AND CONDITIONSOWN RISK AND DAMAGES All guests and clients participate in E-Bike Trail Blazers tours/activities at their own risk. Should the client damage the E-Bike due to his/her negligence, you shall be required to pay for the damages as determined by the Manager on Duty before you leave the activity area. E Bike Trail Blazers will provide invoices for the replacement parts and labour within 14 days and refund the hirer if the damages are claimed to exceed those sustained. CANCELLATION OF ACTIVITY E-Bike Trail Blazers operates in diverse and changeable weather conditions, and all tours and activities are subject to these conditions. Management reserves the right to cancel any activity due to unforeseen circumstances, including but not limited to unavailability, insufficient passengers and/or unfavorable weather conditions. Clients will be assisted in rescheduling affected bookings. If a booking cannot be rescheduled, the new booking price will be refunded within 30 days. In case of a weather cancellation, weather conditions are judged exclusively by the Management of E-Bike Trail Blazers, and guests must report for the activity unless notified by E-Bike Trail Blazers. REFUNDS There will be no refunds in the event of a no-show by a guest on the activity date. Suppose an amendment is not received three days before the activity is booked. In that case, the guest shall be responsible for the full cost of the total number of passengers initially confirmed. > 30 days cancellation before arrival: 100% refund > 15 – 29 days cancellation before arrival: 75% refund > 4 – 14 days cancellation before arrival: 50% refund > 24 hours – 3 days cancellation before arrival: 0% refund > If this product is bought as a Voucher or Gift Voucher, then a 0% refund policy applies. Re-routing of tours in the unlikely event that E-Bike Trail Blazers does not have access to a specific area of the booked service or voucher on the day of the tour, then E-Bike Trail Blazers retains the right to re-route affected tours accordingly. ARRIVAL AT VENUE Kindly ensure you arrive at the venue 30 minutes before your tour departure time. Your tour may be forfeited and not refunded or rescheduled if you arrive later. If, however, you contact us before your tour commencement time, we can make alternate arrangements. Timeously means well beforehand. LOSS OR DAMAGE Loss or damage of any client property. The owners and managers of E-Bike Trail Blazers cannot be held liable or responsible for any loss or damage of any belongings or property of the clients. INDEMNITY All clients will be required to sign an indemnity before the tour takes place. CLIENT IMAGE CONSENT FOR SOCIAL MEDIA Photographs and videos are taken during your service/appointment. These images may be used for promotional purposes on our website and social media platforms. By using our services, you grant us permission to use your likeness captured in these photographs/videos for promotional purposes. If you DO NOT want your image used on our social media platforms or website, you must notify us in writing. Please note: If we do not receive written notification from you opting out, we assume your consent to use your image for promotional purposes as described above. TOUR PRICE All tour prices are subject to change without prior notice. PayGenius terms and conditions E-Bike Trail Blazers is a business in the activity industry. CUSTOMER PRIVACY POLICY E-Bike Trail Blazers shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, ‘personal information’ shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). PAYMENT OPTIONS Payment may be made via Visa, MasterCard, or credit cards for online bookings. Bank transfers or cash will only be accepted for direct bookings into the bank account of E-Bike Trail Blazers, the details of which will be provided on request. Credit card acquiring and security transactions will be acquired for E-Bike Trail Blazers, the approved payment gateway. Customer details are separate from card details. Customer details will be stored by E-Bike Trail Blazers separately from card details, which the client enters on the PayGenius security site. (Detail: www.paygenius.co.za). Merchant outlet country and transaction currency. When presenting payment options to the cardholder, the merchant outlet country is South Africa, and the transaction currency is the South African Rand (ZAR). RESPONSIBILITY E-Bike Trail Blazers takes responsibility for all aspects of the transaction, including the sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. No WAVIER & INDEMNITY This indemnity agreement, effective from the stipulated date, establishes a contractual relationship between EBike Trail Blazers and the participating cyclist. EBike Trail Blazers will be organizing a guided e-bike ride/tour in the Cape Agulhas and surrounding area for the participant. Acknowledging the inherent dangers of e-biking, the cyclist recognizes risks such as road surface hazards, equipment failure, adverse weather conditions, and potential collisions. The participant further asserts their physical fitness and takes responsibility for wearing safety gear, following traffic laws, and complying with rules set by EBike Trail Blazers and landowners. Emphasizing that participation is a personal decision made at their own risk, the cyclist assumes all responsibility for associated medical, legal, or other costs. Regarding the risks involved, the participant voluntarily releases EBike Trail Blazers and its affiliates from any duty of care and liability, relinquishing substantial legal rights. This contract is deemed legally binding, with the participant confirming careful consideration before signing.
